Terms of Service
Welcome to Zeewant Healthcare Pvt. Ltd. (Souljar Mental Health Counselling) (“Zeewant”, “we”, “us”, “our”). These Terms of Service (“Terms”) govern your access to and use of our website, apps, online services, and related digital or downloadable materials (collectively, the “Service”). By accessing or using the Service, you agree to these Terms. If you do not agree, you may not use the Service.
1. Definitions
- User / You / Your: any individual who accesses or uses the Service, whether as a client, guest, member, or otherwise.
- Client: a User who obtains counseling, therapy, or mental health services via Zeewant.
- Counselor / Psychiatric / Coach: a qualified mental health professional who provides services through Zeewant.
- Content: any text, images, audio, video, data, feedback, forums, publications or other materials provided on or through the Service.
- Confidential Information: personal or health information, counseling session content, medical histories, notes, assessments, or other private data.
- Fees: payments, subscription charges, or costs for counseling or other services provided via Zeewant.
- Account: the user account you create to access or use parts of the Service.
2. Eligibility, Registration & Account Security
- Eligibility: You must be at least 18 years old (or legal age in your jurisdiction) and legally capable to enter binding agreements.
- Registration: To access certain features, you may book an Appointment with your email, mobile no., and other required data.
- Accuracy: You agree to provide accurate, current, and complete information when registering or updating your profile.
- Security: You are responsible for safeguarding your password and login credentials. You must notify us immediately of any unauthorized account use or security breach.
- One account per user: Unless permitted otherwise, each person should maintain only one account.
3. Services, Scheduling & Use
- Types of Services: Zeewant may offer individual counseling, group therapy, workshops, assessments, self-help content, webinars, or other mental health services.
- Booking & Scheduling: Clients schedule sessions via the Service. All appointments are subject to availability.
- Cancellations & Rescheduling: You must cancel or reschedule within half an hour before the scheduled session. Late cancellations may incur a fee (see “Fees & Payment”).
- No Guarantee of Outcomes: While counselors and the platform aim to provide high-quality support, we do not guarantee specific outcomes, results, or cures. Progress depends on many factors including your engagement.
- Professional Standard: Counselors will provide services consistent with accepted professional standards, ethics, and applicable licensing or regulatory requirements.
4. Fees, Payment, Refunds
- Fee Structure: Services may be offered on a per-session, subscription, package, or one-time fee basis.
- Payment Methods: We accept Esewa, Khalti, Connect IPS, Mobile Banking Transfers, etc.
- Billing: Unless otherwise stated, payments are due at booking or service start.
- Refunds: Refunds (if any) are at our discretion and governed by our Refund Policy.
- Late/Failed Payments: If payment fails, we may suspend or cancel your access until resolved. You remain liable for owed amounts.
5. User Conduct & Prohibited Use
- Do not use the Service unlawfully.
- No impersonation, harassment, threats, or discrimination.
- No obscene, hateful, violent, or unlawful content.
- No bots, scrapers, reverse-engineering.
- No sharing credentials or unauthorized access attempts.
6. Confidentiality, Privacy & Data Protection
- Client–Counselor Confidentiality: Counselors must maintain confidentiality except in cases of mandated reporting (harm to self or others, abuse, etc.).
- Privacy & Use of Data: We collect and process data as described in our Privacy Policy.
- Data Security: We implement safeguards to protect Confidential Information.
- Disclosures: We may disclose Confidential Information when required by law.
- Anonymized Data: We may anonymize or aggregate data for research, analytics, or service improvements.
7. Intellectual Property & License
- Our Content: All content, trademarks, logos, software, and intellectual property belong to us or our licensors.
- Limited License: You are granted a limited, personal, non-commercial license.
- Restrictions: You may not copy, modify, distribute, sublicense, or commercially exploit our Service without permission.
- User Content: By submitting feedback, reviews, or content, you grant Zeewant a license to use it.
- Trademarks: You may not use our marks without prior consent.
8. Disclaimers & Limitations of Liability
- Medical Disclaimer: The Service is not a substitute for medical or psychiatric diagnosis or treatment.
- No Warranty: The Service is provided “as is” without warranties.
- Limitation of Liability: Zeewant shall not be liable for indirect, incidental, or special damages.
- Cap on Liability: Liability is capped to total fees paid in the prior 12 months.
- Third-Party Services: We are not responsible for third-party tools or integrations.
9. Termination, Suspension & Account Closure
- Termination by You: You may stop using the Service anytime.
- Termination by Us: We may suspend or terminate your access for violations or at our discretion.
- Effect of Termination: You must cease all use, and we may delete your account/data unless required to retain by law.
10. Dispute Resolution, Governing Law & Jurisdiction
- Governing Law: These Terms are governed by the laws of Nepal.
- Informal Resolution: You agree to attempt informal resolution before litigation.
- Court Jurisdiction: Disputes shall be handled in courts located in Kathmandu, Nepal.
